Terms and Conditions

Eligibility

The Contest is open to anyone 18 years of age or older at the time the Contest commences, subject to limitations on prizes for non-US residents. Employees of the Alliance for Biking & Walking, their immediate family members, and sponsors of this contest can participate but are not eligible to receive prizes. The Contest is subject to all federal, state and local laws and regulations. Judges (and their immediate family members and members of the same households, whether related or not) can participate, but are not eligible to receive prizes. Void where prohibited by law. Participants agree to abide by the terms of these Official Rules and by the decisions of the Sponsors which are final and binding on all matters pertaining to this Contest.

Contest Procedure and Rules

The Sponsors have created a user-generated photo contest that will benefit a Biking & Walking Advocacy Photo Library. By submitting a photo to this contest, you are authorizing the Alliance for Biking & Walking to place your photo into this photo library. In addition, you authorize the Alliance and all members organizations of the Alliance to use the photo for charitable purposes related to advocating for biking and walking. In order to be eligible, you must enter each image in at least one of the following 7 categories (Note: some photographs may span across categories, for example: a photograph of bikers and walkers in a parade could be submitted under the categories 'Biking,' 'Walking,' and 'Biking and Walking'). The Alliance reserves the right to switch images to other categories and include photo entries only in categories it deems appropriate.

  1. Biking – people biking or shots that are emblematic of cycling
  2. Walking – people walking or shots that are emblematic of walking
  3. Biking and Walking – both biking and walking are represented in the same photo
  4. Complete Streets – these photos show pedestrians, cyclists and drivers sharing the road. They demonstrate people using all types of transportation and streets that are built for all sorts of people. They include infrastructure (bike lanes, sidewalks, bike/walk paths) and shots that are emblematic of "livable streets". This category can also include emblematic shots of incomplete streets, those that are hostile to cyclists, pedestrians, and people with disabilities.
  5. Advocates in Action – these photos show biking and/or walking advocates in action. Examples might include a speaker in front of a supportive crowd at City Hall, advocates holding signs supporting or encouraging biking and walking, or other illustrative advocacy actions.
  6. Youth – these photos illustrate youth (0-18) cycling or walking. Examples might include a family ride, kid on a trike, child learning to bike, walking to school, etc. NOTE: any photos with an identifiable subject must obtain a photo release form from the parents of the minor to be eligible.   7. Inspirational – What inspires you about biking and walking? What photos would inspire others? Think about what is possible for communities. Examples might include a shot with more bicycles and pedestrians than cars on a city street or a city street filled with bicycle traffic.

How to enter the contest: Beginning at 12:00:01 pm Noon EST on September 1, 2009 and continuing until 11:00:00pm ET on November 31, 2009, you can visit www.peoplepoweredmovement.org/photocontest ("website") to upload your photo(s). Photo(s) should:

  • Be useful to biking and walking advocacy
  • Show the people and faces of biking and walking
  • Represent the "everyday" cyclist or walker
  • Show diversity
  • Have aesthetic quality
  • Be generic/universal images
  •    
  • Be from North America
  • Be creative!
  • Adhere to category guidelines

Each individual is eligible to submit up to 20 photos. Photographs must be in digital format. No print or film submissions will be accepted for entry into this Contest. All digital files must be 5 megabytes or smaller, must be in JPEG or .jpg format, and must be at least 300 dpi (dots per inch or pixels per inch). All images must be digitally uploaded. Mailed or shipped entries will not be accepted.

Photos may NOT contain:

  • 3rd party stock photography or artwork or any copy
  • Nudity, lewd or vulgar behavior; offensive gestures

All ideas submitted will be posted to the Contest website with your first name and the state where you live, but no other identifying information.

All entries must be appropriate for all audiences. Photos referencing sex, drugs, or violence will not be accepted as entries. Any photo that includes content that is deemed inappropriate, indecent, obscene, as determined by the Sponsors in their sole discretion, will not be eligible. Entrants represent and warrant that

  1. The photos that they submit: are their own original creations and do not infringe any other person’s or entity’s rights;
  2. they have obtained permission, if applicable (photos with identifiable subjects who are minors and photos whose main subject is a person, require releases from these subjects), from the people featured in the photo(see the Alliance’s photo release form here) to enter this Contest; and
  3. the submission of the photo will not violate any enforceable agreements or understandings submitter has with any third party.

You can submit up to 20 photos. Submissions must be made in English. Each photo must be submitted in the name of one, and only one, entrant. You must also provide a valid email address when you submit an entry. By entering the Contest you grant the Sponsors the right to contact you regarding your entry, publicize your entry, promote your entry for any other purpose related to the Contest and/or broadcast your entry.

Web viewers will have a chance to vote and choose 10 photos from each of the seven categories from among the eligible entries, which will display on the Contest website. Out of the 70 photos, judges will narrow the photos to the winning entries.

Grant of Rights in Photos Submitted

Entrants retain their ownership and other rights to their photos except that submission of a photo constitutes the irrevocable right to Sponsors of all rights in the photo, all rights to use, copy, sublicense, edit, modify, make derivative works, publish, exploit, transmit, distribute, publicly perform, publish, delete or display the content of and elements embodied in the photo and the photo itself, in whole or in part, in perpetuity in any and all media (whether now existing or hereafter devised) without limitation, and without consideration or acknowledgment to the entrant and the unconditional right to use the idea and statements about the photo for advertising/publicity purposes without additional compensation, except where prohibited by law.

Cost

There is no cost to participate in the Contest. No purchase is necessary.

Prizes

The Grand Prize winner will be awarded an all expense paid bike tour of Tuscany (or VBT Bicycling & Walking Vacations tour of equivalent value), air fare (from certain east coast airports), lodging, and meals and a year’s supply of CLIF BARs (16 boxes) with an approximate total retail value (TRV US$) of $4,365. The Second Place winner will be awarded a brand new Breezer Uptown 8 commuter bike AND a Rickshaw Zero Messenger Bag (filled with CLIF BARs and Planet Bike 10w Metal Halide Light w/ Intelli Charger) TRV of $1,683. The third place winner will be awarded a brand new Dahon Mμ™ P24 folding bike TRV of $949. The First Place winners in each category will be awarded a Rickshaw Zero Messenger Bag (filled with CLIF BARs, a Planet Bike Superflash Tail Light and Blaze One Watt Headlight Set, and subscription to Momentum Magazine and Bicycle Times TRV $255. Second place winners in each category will be awarded a box of CLIF BARs (12 pack), a Planet Bike BRT Strap LED Safety Light and "Global Cooling Machine" T-shirt, and subscription to Momentum Magazine and Bicycle Time TRV $71. Third place winners in each category will be awarded a box of CLIF BARs (12 pack), a Planet Bike "Global Cooling Machine" t-shirt, and subscription to Momentum Magazine and Bicycle Times TRV $55. The approximate aggregate TRV is $9,664. In addition, the Grand Prize winner, Second Place winner, Third Place winner, and First Place winners in each category will have their winning photos published in the 2010 March/April issue of Momentum Magazine. The Grand Prize winner will also select their local Alliance organization to receive a $1,000 Communications Grant. The Sponsors reserve the right to substitute prizes of equal or greater value. Unless where otherwise stated, prizes are non-transferable, assignable or redeemable for cash.

Notification

Winners will be notified via email within approximately seven (7) business days after determination that they are eligible to receive a prize (February 2010). They will be asked to confirm their phone number and mailing address. Entrants who do not provide a valid e-mail address with their initial submission will forfeit any prizes. If an entrant cannot be reached by email within ten (10) business days of the first attempt to notify them, the prizes may be forfeited and the next successful entrant will receive said prizes.

Criteria

Contest Judges and the web viewers will select the photos that are the most useful to biking and walking advocacy, show the people and faces of biking and walking, represent the "everyday" cyclist or walker, show diversity, have aesthetic quality, are generic/universal images, are creative, and adhere to category guidelines. (See contest homepage for descriptions of the judging criteria). At the discretion of the Sponsors, such criteria may not be given equal weight.

Dates

The Contest will begin on September 1, 2009. Submissions can be entered starting on September 1, 2009 and will be accepted until November 31, 2009. The initial voting period to select the top 10 photos from each category chosen by web viewers will be held from November 1, 2009 to December 31, 2009. Announcement of winners will be made on March 1, 2009. Judges' voting to narrow the 70 entries down to the winners, will commence on January 4, 2010 and continue until January 31, 2009. All dates are subject to change at the discretion of the Sponsors. In such case, that dates are changed or extended, notice of such change will be posted on the Contest website.

Delivery of Prizes

Prizes will be sent by mail to the addresses provided; shipping costs are included. The Sponsors shall not be responsible for misdelivery of any documents and/or prizes provided that the Sponsors address the documents and/or prizes to the address provided by the winner. awarding of their prizes, the prizes will be shipped to them.

Announcement of Winnerss

The Sponsors will announce the winners and post their full names and city and state of residence on the web site following the completion of the Contest.

Use of Winners' Names and Likeness

Each winner who accepts any prize will be deemed thereby to have granted to the Sponsors the right, at any time and from time to time, to print, publish, broadcast and use, worldwide and in any media now known or hereafter developed, including but not limited to, the Internet and world wide web, the name, portrait, picture, voice, likeness and biographical information of each such winner as news or information and for advertising and promotional purposes without additional consideration, except where prohibited by law.

Disqualification

The Sponsors reserve the right, in its sole discretion, to disqualify any participant that it determines, in its sole discretion, is ineligible to participate in the Contest. Failure to comply with these rules may result in a participant's disqualification.

Limitation of Liability

If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsors reserve the right at their sole discretion, to disqualify any individual who tampers with the Contest, and to cancel, terminate, modify or suspend the Contest. The Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsors are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail to be received by the Sponsors on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest.

Limitation of Remedies

UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL THE SPONSORS OR AFFILIATED ENTITIES OR ITS SUCCESSORS OR ASSIGNS, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, OR EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO LOSS OF PROFITS OR HARM TO BUSINESS OR REPUTATION, ARISING OUT OF PARTICIPATION IN THE CONTEST, POSTING ON OR ACCESS AND/OR DOWNLOAD OF ANY MATERIALS OR INFORMATION FROM ANY WEB SITE OWNED, OPERATED OR CONTROLLED BY THE SPONSORS OR AFFILIATED ENTITIES, OR ACCEPTANCE OR USAGE OF A PAYMENT, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY AND, TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAMAGES FOR BODILY OR PERSONAL INJURY, EVEN IF THE SPONSORS OR ANY AFFILIATED ENTITES, THEIR SUCCESSORS OR ASSIGNS, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AGENTS OR REPRESENTATIVES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSS. THE AGGREGATE LIABILITY OF SPONSORS ARISING OUT OF ANY KIND OF CLAIM (WHETHER IN CONTRACT, TORT, OR OTHERWISE) SHALL NOT EXCEED $1.00. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

Amendments

The Sponsors reserve the right to suspend, cancel, terminate or modify the Contest without advance notice, and thereafter to re-commence such Contest, if at all, only at such time(s) and upon such terms and conditions as we shall deem reasonable under the circumstances.

Severability

If any one or more provisions of these Official Rules are held to be invalid, illegal or unenforceable by a court of competent jurisdiction, such invalidity, illegality or unenforceability shall not affect the validity, effect or enforcement of any other provision or provisions of these Official Rules.

Winners List

A list of winners will be posted on the web site at the conclusion of the Contest.
